Terms and Conditions for Transport Services

§1 GENERAL PROVISIONS

  1. These regulations were prepared based on Article 4 of the Act of November 15, 1984 – Transport Law (consolidated text Journal of Laws 2017, item 1983).
  2. The following regulations define the rules for transporting people and luggage by EKOLO Krzysztof Oleś, Tax Identification Number (NIP) 8392353676
  3. The terms used in the regulations should be understood as:
  4. Carrier – EKOLO Krzysztof Oleś company, with its registered office at 76-200 Słupsk, ul. Braille’a 25/10
  5. Transportation agreement – an agreement concluded between the Carrier and the Passenger at the time of booking seats; based on this agreement, the Carrier undertakes to transport the Passenger and their luggage on a specified route for a specified fee.
  6. Passenger – a natural person (including a person with limited mobility), a legal person or an organizational unit, using the transportation service
  7. Ordering person – a person placing an order for transport services by phone, email, or through the WhatsApp application,
  8. Driver – a natural person, performing transportation of people and luggage based on an agreement with EKOLO Krzysztof Oleś company
  9. Transport service – transportation service by means of transport on the route reserved by the passenger.
    10, Means of transport – a passenger car used by the Carrier to provide the transport service.
  10. Reservation confirmation – a personal document confirming the acceptance of the order for the transport of the person/people indicated therein on the specified route, on the specified date, for the agreed price and any technical arrangements.

§2 RESERVATION AND PAYMENT FOR THE SERVICE

  1. Making a transfer reservation means entering into an agreement (transportation agreement) and accepting the provisions of these regulations.
  2. Reservation is associated with payment for the journey in the form chosen by the Customer.
  3. An unpaid journey is not a reservation.
  4. Reservation is possible through the email address kontakt@ekolobus.com, phone number +48 662 051 431, and the WhatsApp application.
  5. Each reservation containing correct data is duly confirmed by the carrier; in case of not receiving a confirmation – please contact us urgently by phone.
  6. The Ordering Person assumes full responsibility for the data provided to the Carrier during online or telephone reservation and is obliged to check the correctness of such data as: date, time, pick-up location, destination address, contact phone number and personal data of the Passenger.
  7. Payment for the service can be in the following forms:
  • cash to the driver,
  • BLIK payment, directly to the driver,
  • bank transfer to the account: PL 74 2490 0005 0000 4530 7376 5019, SWIFT: ALBPPLPW.

§3 RIGHTS AND OBLIGATIONS OF THE CARRIER

  1. The Carrier strives to carry out the transportation of the passenger and their luggage on the route specified in the transport agreement;
  2. The Carrier endeavors to provide Passengers with appropriate travel conditions, in accordance with safety and hygiene rules.
  3. In case of a bus or minibus breakdown, the Carrier will take all necessary steps to provide a replacement means of transport to continue the journey.
  4. In case of airport transfers – the Carrier is not responsible for damages or delays resulting from:
    incorrect or incomplete information about the passenger’s departure or arrival traffic disruptions, road checks, adverse weather conditions, customer delays or other unforeseen events.
  5. The Carrier insures Passengers against the consequences of accidents (personal accident insurance) during the journey, but is not responsible for damages occurring outside the vehicle.
  6. The Carrier has the right to refuse to take or leave the Passenger on the route if the Passenger:
  • is intoxicated or under the influence of drugs;
  • does not comply with these Regulations;
  • behaves in a manner that is bothersome to passengers or may endanger the safety, punctuality or continuity of transportation.

The threat referred to in § 3, para. 7 is determined at the discretion of the Driver or another person authorized by the Carrier.

§4 PASSENGER OBLIGATIONS

  1. The Passenger is obliged to have and show the driver a valid identification document.
  2. The Passenger is obliged to arrive at the pick-up point at least 10 minutes before the scheduled departure time.
  3. The Passenger is obliged to follow the driver’s instructions.
  4. The Passenger is obliged to fasten their seat belts.
  5. The Passenger is responsible for any damage caused to other passengers or the Carrier.
  6. Due to the specificity of airport transfers – in case of delays, changes or any problems with finding transportation, please contact the emergency number available 24 hours +48 662 051 431. Complaints will not be considered in case of lack of phone contact from the Customer.
  7. The transport of children and their age must be reported to the Carrier in advance due to safety requirements.
  8. Transport of children: up to 12 years old – only under the supervision of an adult, 12-18 years old – based on parental authorization.
  9. Passengers are not allowed to consume alcohol, use drugs or smoke tobacco, including electronic cigarettes, inside the means of transport.
  10. The fee for soiling the means of transport by the Passenger is 200 PLN.
  11. The transport of animals is prohibited.

§ 5 LUGGAGE

  1. The Passenger has the right to carry two pieces of luggage free of charge (one carry-on, which placement does not pose a significant problem, and a second one placed in the luggage compartment, the maximum weight of which is in accordance with the airline’s luggage regulations serving the Customer’s flight).
  2. Luggage that will be placed in the luggage compartment must be packed in such a way that it does not become damaged or deformed during the journey.
  3. The Passenger is obliged to mark their luggage placed in the luggage compartment in a way that allows its identification.
  4. If a particular piece of luggage does not meet the requirements set out in these Regulations, the driver has the right to refuse to carry the luggage.
  5. Luggage must not be placed on seats.
  6. Luggage must be collected by the passenger upon arrival at the destination where the journey ends.
  7. The Carrier is not responsible for items left by passengers inside the means of transport.
  8. The Carrier has the right to refuse to carry luggage with excessive weight or non-standard dimensions if such luggage has not been previously reported.

§ 6 CHANGES OR CANCELLATION OF THE AGREEMENT

  1. Changes to the transport reservation may concern both the transport date and the transported luggage.
  2. If the Passenger or Ordering Party cancels the reservation at least 48 hours before the scheduled transfer, they receive a full refund of the reservation fee, reduced by a handling fee (bank charges) of 5 PLN for domestic payments and 25 PLN for international payments.
  3. If the Passenger or Ordering Party cancels the reservation at least 24 hours before the scheduled transfer, they receive a 50% refund of the reservation fee, reduced by a handling fee (bank charges) of 5 PLN for domestic payments and 25 PLN for international payments.
  4. In case of canceling the reservation less than 24 hours before the transfer, the reservation fee is non-refundable.
  5. Any changes or cancellation of a reservation require electronic notification to the email address kontakt@ekolobus.com

§ 7 CARRIER’S WITHDRAWAL FROM TRANSPORT

  1. The Carrier may withdraw from transport if circumstances make it impossible to prevent or avoid events caused by force majeure (weather conditions, traffic bans, other sudden political-economic conditions).
  2. The Carrier may withdraw from transport in case of the Customer’s absence at the specified transfer time and simultaneous lack of email/telephone contact with the Customer.
  3. The Carrier reserves the right to change the transfer hours from and to the airport.
  4. The Carrier reserves the right to cancel transport without giving a reason at least 24 hours before the scheduled departure. In this situation, the Customer has the right to a 100% refund of the ticket value.
  5. The Carrier may withdraw from transport if the passenger has not complied with the transport regulations or due to the nature of the transport, it is impossible to perform it using transport means and equipment, which the passenger did not report when making the reservation.

§ 8 COMPLAINTS

  1. Complaints should be directed to the email address kontakt@ekolobus.com or in writing to the Carrier’s address.
  2. Regarding transport services, the Carrier responds to the submitted complaint within 30 days from the date of acceptance of the complaint.
  3. In case of formal deficiencies, the Carrier calls the complainant to remove them within 14 days from the date of receiving the summons, with a warning that failure to supplement the deficiencies within this period will result in leaving the complaint unexamined.

§ 9 FINAL PROVISIONS

  1. In matters not regulated by the provisions of these Regulations, the following provisions shall apply: the Act of November 15, 1984 on Transport Law (Journal of Laws 1984 No. 53, item 272, as amended) and the Act of 1964 Civil Code (Journal of Laws 1964 No. 16, item 93, as amended).
  2. In case of any disputes, the District Court competent for the Carrier’s registered office shall be competent to resolve them.
